1. About MojoDojo
MojoDojo is a music teaching management platform designed to help music teachers and studios manage students, schedules, lesson notes, lesson reminders, learning resources, practice tracking, progress information, communication and related music teaching administration.
These Terms and Conditions apply to the MojoDojo website, web app, student app, mobile app when released, and any related services, features or tools provided by MojoDojo.
In these Terms:
- MojoDojo, we, us and our means MojoDojoHQ Pty Ltd.
- User, you and your means any person who accesses or uses MojoDojo, including teachers, students, parents, guardians, administrators and trial users.
- Teacher means a music teacher, tutor, studio operator, business owner or authorised staff member using MojoDojo to manage music teaching.
- Student means a person receiving music lessons or music education through a teacher using MojoDojo.
- Parent or Guardian means a parent, guardian or authorised adult responsible for a student who is under 18.
- Child means a person under 18 years of age.
- Content means any material uploaded, created, sent, stored or shared through MojoDojo, including lesson notes, messages, files, images, audio, video, progress information and learning materials.
2. Acceptance of these Terms
By creating an account, starting a trial, purchasing a subscription, accessing the platform, using the student app, or continuing to use MojoDojo, you agree to these Terms and Conditions.
If you do not agree, you must not use MojoDojo.
If you are using MojoDojo on behalf of a business, music studio, school or other organisation, you confirm that you have authority to accept these Terms on behalf of that organisation.
3. Eligibility and account roles
MojoDojo may be used by:
- Teachers and music studios;
- Students;
- Parents or guardians;
- Authorised administrative users; and
- Other users approved by MojoDojo.
Student accounts must only be created for genuine music education purposes.
Children must not create or operate accounts without the involvement and consent of a parent, guardian or authorised teacher, depending on the account type and settings used.
MojoDojo may require additional verification, consent or account controls for child users.
4. Child and student use
MojoDojo may be used in connection with children and young people. Because of this, all users must use the platform safely, respectfully and only for appropriate music education purposes.
Teachers are responsible for:
- Ensuring they have appropriate consent to add students to MojoDojo;
- Ensuring parent or guardian involvement where required;
- Using MojoDojo in a professional and appropriate way;
- Complying with any child safety, working with children, professional conduct, studio, school or legal obligations that apply to them;
- Ensuring student information entered into MojoDojo is accurate, relevant and not excessive; and
- Not using MojoDojo to contact students for non-educational or inappropriate purposes.
Parents and guardians are responsible for:
- Supervising or supporting a child's use of MojoDojo where appropriate;
- Keeping their own login details secure;
- Reviewing any information provided about their child; and
- Contacting the teacher or MojoDojo if they have a safety, privacy or access concern.
Students are expected to:
- Use MojoDojo only for music learning;
- Communicate respectfully;
- Not share inappropriate, harmful, offensive, private or unlawful content; and
- Tell a parent, guardian or trusted adult if anything on the platform makes them feel uncomfortable or unsafe.
5. Acceptable use
You must not use MojoDojo to:
- Bully, harass, threaten, groom, exploit or harm another person;
- Send or request inappropriate personal information;
- Share sexual, violent, abusive, discriminatory or exploitative content;
- Upload content that infringes another person's copyright or rights;
- Record, upload or share a person's image, voice, lesson, performance or personal information without appropriate consent;
- Circumvent security, access controls, payment systems or account restrictions;
- Introduce viruses, malicious code or harmful material;
- Scrape, copy, reverse engineer or misuse the platform;
- Use the platform for unlawful activity; or
- Use student data for advertising, profiling, unrelated marketing or non-educational purposes.
MojoDojo may suspend or terminate access if we reasonably believe an account has been used in breach of these Terms or creates a safety, privacy, security, legal or reputational risk.
6. Teacher responsibilities
Teachers remain responsible for their own music teaching business, studio practices, student relationships, communications, legal obligations, billing arrangements and professional conduct.
MojoDojo provides software tools. MojoDojo does not employ, endorse, supervise or verify every teacher using the platform unless expressly stated in writing.
Teachers must ensure that any content they upload or send through MojoDojo is lawful, appropriate and suitable for the student's age, learning needs and circumstances.
Teachers are responsible for obtaining any required parent or guardian consent before uploading or sharing student information, lesson notes, recordings, images, videos or learning materials involving children.
Teachers are also responsible for ensuring that any staff, contractors or other users they invite or authorise to use an account comply with these Terms.
7. Parent and guardian consent
Where a student is under 18, MojoDojo may require parent or guardian consent for account creation, communication features, practice tracking, uploads, recordings, notifications or other features.
A parent or guardian may request access to, correction of, or deletion of their child's personal information, subject to legal, safety, technical and account administration requirements.
MojoDojo may restrict or disable a child's account if consent is withdrawn or cannot be verified.
8. Content uploaded to MojoDojo
Users may upload, create or share Content such as lesson notes, practice goals, progress notes, videos, audio files, PDFs, images, teaching explanations, sheet music, exercises, messages and other learning materials.
You retain ownership of Content you upload, subject to any rights owned by others.
By uploading Content, you grant MojoDojo a limited licence to host, store, process, display, transmit and use that Content only as reasonably necessary to provide, maintain, secure and improve the platform and to carry out the functions you request through the platform.
You must only upload Content if you have the right to do so.
You must not upload copyrighted music, sheet music, recordings, images, videos or teaching materials unless you own them, have permission, have a valid licence, or are otherwise legally allowed to use them.
9. Music copyright and learning materials
MojoDojo is a platform for music education management. Users are responsible for ensuring that any music, sheet music, backing tracks, recordings, videos, lyrics, teaching resources or other materials uploaded or shared through MojoDojo comply with copyright law and licensing requirements.
MojoDojo may remove or restrict access to Content if we reasonably believe it infringes copyright, breaches these Terms, or creates a legal, privacy or safety risk.
10. In-app messaging and communication
MojoDojo may include communication tools between teachers, students and/or parents.
Communication through MojoDojo must be limited to appropriate music education, scheduling, lesson, practice and learning purposes.
Teachers should use professional judgement when communicating with students, particularly children.
MojoDojo may review, restrict, suspend or disclose communications where reasonably necessary for safety, security, legal compliance, complaint handling, platform integrity or investigation of misuse.
11. Subscriptions, payment and billing
MojoDojo may offer free trials, paid subscriptions, promotional offers, monthly plans, annual plans or other pricing options.
The price, billing cycle, included features and renewal terms will be shown at or before purchase.
By purchasing a subscription, you authorise MojoDojo or its payment provider to charge the applicable fees using your selected payment method.
Subscriptions may renew automatically unless cancelled before the renewal date, where automatic renewal is offered.
MojoDojo will aim to make renewal, cancellation and billing terms clear at the point of purchase.
You are responsible for keeping payment details up to date.
12. Free trials and promotions
If MojoDojo offers a free trial or promotional period, the relevant terms will be displayed at sign-up.
At the end of a free trial, your subscription may convert to a paid subscription if this was clearly disclosed and accepted at sign-up.
You may be required to cancel before the trial ends to avoid being charged.
13. Cancellations
You may cancel your subscription in accordance with the cancellation process made available through the platform, app store, payment provider, or by contacting MojoDojo.
Cancellation will usually take effect at the end of the current paid billing period unless otherwise stated.
Deleting the app or ceasing to use the platform may not automatically cancel a subscription. Users should follow the proper cancellation process.
14. Refunds
Refunds will be handled in accordance with Australian Consumer Law and any applicable app store, payment provider or platform rules.
Nothing in these Terms excludes, restricts or modifies any rights you may have under Australian Consumer Law or other laws that cannot be excluded.
MojoDojo is not required to provide a refund merely because you change your mind, forget to cancel, no longer need the service, or do not use the service, unless required by law or expressly offered by MojoDojo.
15. Australian Consumer Law
If you are a consumer under Australian Consumer Law, our services come with guarantees that cannot be excluded.
Where there is a major failure or other breach of a consumer guarantee, you may be entitled to remedies under Australian Consumer Law.
Nothing in these Terms limits your rights under Australian Consumer Law.
16. Availability and changes to the platform
MojoDojo aims to provide a reliable platform, but we do not guarantee that the platform will always be available, uninterrupted, error-free or compatible with every device, browser or operating system.
We may modify, suspend, update or discontinue features from time to time.
Where a change materially affects paid users, we will take reasonable steps to provide notice.
17. App stores
MojoDojo may become available through app stores. If you download or subscribe through an app store, additional app store terms may apply.
Where there is inconsistency between these Terms and mandatory app store terms, the app store terms may apply to the extent required.
18. Privacy
Your use of MojoDojo is also governed by our Privacy Policy.
The Privacy Policy explains how we collect, use, disclose, store and protect personal information, including information about children and students.
19. Security
You are responsible for keeping your account login details secure.
You must tell us promptly if you suspect unauthorised access to your account.
MojoDojo will take reasonable steps to protect the platform and personal information, but no online service can guarantee complete security.
20. Suspension and termination
MojoDojo may suspend, restrict or terminate your access if:
- You breach these Terms;
- Payment is not made when due;
- We reasonably suspect misuse, fraud, unlawful activity or security risk;
- We reasonably believe there is a child safety, privacy or wellbeing concern; or
- We are required to do so by law, regulator, court order, app store or payment provider.
Where appropriate, we will give notice and a reasonable opportunity to respond. However, we may act immediately where needed to protect users, children, data, platform security or legal compliance.
21. Data after account closure
When an account is closed, MojoDojo may retain certain information for a limited period where reasonably required for legal, accounting, security, dispute resolution, child safety, backup, audit or legitimate business purposes.
MojoDojo will delete or de-identify personal information when it is no longer reasonably required, unless retention is required or permitted by law.
22. Overseas users
MojoDojo is operated from Australia. Users outside Australia are responsible for ensuring their use of MojoDojo is lawful in their location.
If MojoDojo is used outside Australia, additional privacy, consumer, child protection, education, tax or platform laws may apply. MojoDojo may restrict access in some locations if required.
23. Liability
To the maximum extent permitted by law, MojoDojo is not liable for:
- A teacher's professional conduct;
- A student's learning outcome;
- User-uploaded Content;
- Loss caused by inaccurate information entered by users;
- Third-party services, payment providers, app stores or integrations;
- Loss of data caused by user error or unauthorised account access; or
- Indirect, special or consequential loss.
Nothing in these Terms excludes liability that cannot be excluded by law.
24. Indemnity
You agree to indemnify MojoDojo for loss, damage, claims or expenses arising from your breach of these Terms, misuse of the platform, unlawful Content, infringement of rights, or failure to obtain required consent, except to the extent caused by MojoDojo's own unlawful conduct, negligence or breach of duty.
25. Changes to these Terms
MojoDojo may update these Terms from time to time.
If changes are material, we will take reasonable steps to notify users.
Continued use of MojoDojo after the updated Terms take effect means you accept the updated Terms.
26. Governing law
These Terms are governed by the laws of the Australian Capital Territory and the Commonwealth of Australia.
The parties submit to the courts of the Australian Capital Territory and any courts entitled to hear appeals from those courts.
